You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

(b) Transmit any harmful or malicious code, viruses, or other materials through the Site;

4. Scheduling and Consultations

Our Site uses Acuity Scheduling to enable visitors to book consultation calls. By scheduling an appointment, you agree to provide accurate contact information and to attend the scheduled appointment or provide reasonable advance notice of cancellation. We reserve the right to cancel or reschedule appointments at our discretion with appropriate notice.

5. Intellectual Property Rights

The Site and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Code & Craftworks, LLC, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

6. Client Work and Portfolio Use

Code & Craftworks retains the right to display completed client work in our portfolio and marketing materials unless otherwise agreed upon in writing with the client. Specific intellectual property rights related to client projects are governed by individual service agreements.

Our Site uses third-party services including Squarespace (hosting platform), Acuity Scheduling (appointment booking), Square and HoneyBook (payment processing), and Google Analytics (website analytics). Your use of these services is subject to their respective terms of service and privacy policies.

8. Payment Terms

Payment for services is processed through Square or HoneyBook, based on client preference. Specific payment terms, including deposits, milestones, and due dates, are outlined in individual service agreements or invoices.

All fees are non-refundable unless otherwise stated in a signed service agreement. Clients are responsible for all third-party platform fees associated with their projects, including but not limited to hosting, domain registration, subscription services, and transaction fees.

9. Disclaimer of Warranties

THE SITE AND ALL INFORMATION, CONTENT, MATERIALS, PRODUCTS, AND SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SITE ARE PROVIDED BY CODE & CRAFTWORKS ON AN “AS IS” AND “AS AVAILABLE” BASIS, UNLESS OTHERWISE SPECIFIED IN WRITING.

CODE & CRAFTWORKS MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE SITE OR THE INFORMATION, CONTENT, MATERIALS, PRODUCTS, OR SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SITE, UNLESS OTHERWISE SPECIFIED IN WRITING. YOU EXPRESSLY AGREE THAT YOUR USE OF THE SITE IS AT YOUR SOLE RISK.

12. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or related to these Terms or their subject matter or formation shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in New York State, and you hereby irrevocably consent to personal jurisdiction and venue in such courts.
